Entrepreneurs and self-employed persons have the legal obligation to verify whether a (sub)contractor has fiscal or non-fiscal debts with the FPS Finance or National Social Security Office before paying the invoice.
The withholding obligation applies in the construction, meat and guarding and/or supervisory services sectors.
You can look up whether these debts exist at www.checkinhoudingsplicht.be.
A certificate of consultation can be created and is valid for a limited time.
If there are debts, you may not pay the full invoice to the (sub)contractor.
